Terms of Use, Subscription Terms, and Financial Disclaimer

These Terms of Use, Subscription Terms, and Financial Disclaimer (“Terms”) govern your access to and use of The Rosenblum Technical website, newsletters, email communications, charts, reports, social-media content, subscriber materials, and related services collectively referred to as the “Service.”

The Service is owned and operated by Rosenblum Consulting, Inc., referred to in these Terms as “Rosenblum Consulting,” “The Rosenblum Technical,” “we,” “us,” or “our.”

By accessing the Service, creating an account, purchasing a subscription, or continuing to use the Service, you acknowledge that you have read, understood, and agreed to these Terms. If you do not agree, do not access, subscribe to, or use the Service.

1. Nature of the Publication

The Rosenblum Technical is an independent publication providing technical market analysis, market commentary, charts, research, and educational information.

The Service is intended to be a general and impersonal publication. Its content is prepared for a broad audience and is not tailored to any particular reader’s:

  • Investment portfolio or existing positions;
  • Investment objectives;
  • Financial condition;
  • Income or net worth;
  • Tax circumstances;
  • Liquidity requirements;
  • Investment experience;
  • Time horizon; or
  • Risk tolerance.

Your subscription creates a publisher-subscriber relationship only. It does not create an investment-adviser relationship, brokerage relationship, fiduciary relationship, client relationship, agency relationship, partnership, joint venture, or other professional relationship.

All content provided through the Service is for general informational and educational purposes only.

Nothing published or communicated through the Service constitutes or should be understood as:

  • Personalized investment advice;
  • Financial-planning advice;
  • Trading advice;
  • Tax advice;
  • Accounting advice;
  • Legal advice;
  • A fiduciary recommendation;
  • An offer to sell a financial instrument;
  • A solicitation to purchase a financial instrument;
  • A recommendation to buy, sell, short, hold, hedge, or allocate capital to any security, commodity, futures contract, option, digital asset, or other financial instrument; or
  • A representation that any financial instrument, strategy, or course of action is suitable for you.

References to securities, indexes, exchange-traded funds, commodities, futures, options, market sectors, economic conditions, technical levels, support, resistance, trends, volatility, positioning, market structure, or possible scenarios are components of general market analysis. They are not instructions for any reader to enter, exit, size, or manage a position.

Rosenblum Consulting does not review subscriber portfolios, determine suitability, prepare individualized allocations, manage subscriber assets, accept or transmit securities orders, execute transactions, hold subscriber funds, exercise trading discretion, or provide automated or copy-trading services.

You are solely responsible for your financial and investment decisions. Before making a financial decision, you should independently evaluate the relevant facts and consult appropriately qualified and licensed financial, legal, accounting, or tax professionals regarding your individual circumstances.

Do not send us brokerage credentials, account statements, portfolio balances, tax records, or other sensitive financial information.

3. Investment and Trading Risks

Investing and trading involve substantial risk. Financial markets are uncertain, volatile, and subject to events that cannot be predicted or controlled.

You may lose some or all of the money committed to an investment or transaction. Certain instruments and activities—including options, futures, short sales, margin, leveraged products, and other derivatives—may involve heightened risk. Depending on the instrument and transaction, losses may exceed the amount initially committed.

Technical analysis is inherently interpretive. Support levels, resistance levels, trend channels, moving averages, momentum signals, volatility measures, options-derived levels, and other technical indicators may fail, move, become irrelevant, or be interpreted differently by other analysts.

No analysis, market framework, indicator, chart, publication, or commentary can eliminate investment risk or guarantee a particular outcome.

4. No Guarantee of Results

Rosenblum Consulting makes no guarantee or representation concerning:

  • Investment performance;
  • Trading performance;
  • Profitability;
  • Preservation of capital;
  • Risk reduction;
  • Accuracy of a forecast;
  • Accuracy of a technical level;
  • Timing of a market move;
  • Achievement of a stated scenario;
  • Availability of market liquidity;
  • Execution at a particular price;
  • Completeness of information;
  • Continued availability of content; or
  • The usefulness of the Service for any particular purpose.

References to historical market behavior, prior market calls, previous analysis, or past outcomes are not guarantees or reliable indicators of future results.

Unless a publication expressly states otherwise, references to gains, losses, price movements, or percentage changes describe movements in markets or financial instruments. They do not represent the performance of any subscriber, brokerage account, portfolio, managed account, proprietary account, or investment strategy.

5. Market Views and Opinions

Market commentary reflects the author’s analysis and opinion at the time the content is prepared.

Market conditions can change rapidly. Views, conclusions, levels, scenarios, and interpretations may:

  • Change at any time without notice;
  • Become outdated soon after publication;
  • Differ from earlier publications;
  • Be revised as additional information becomes available; or
  • Prove to be incorrect.

Rosenblum Consulting is not obligated to update, supplement, withdraw, or reconcile previously published content merely because market conditions, data, assumptions, or opinions have changed.

A publication should be evaluated as of its stated publication date and time. Content should not be assumed to remain current merely because it remains accessible in an archive, search result, email, social-media feed, or other location.

6. Data, Charts, Technical Levels, and Analytical Limitations

The Service may rely on market data, economic data, company information, third-party information, public filings, news reports, exchange data, broker data, vendor data, calculated values, automated processes, statistical methods, algorithms, and artificial-intelligence-assisted tools.

Although reasonable efforts may be made to review and present information accurately, Rosenblum Consulting does not warrant that any information is accurate, complete, current, error-free, or suitable for a particular purpose.

Information may contain or be affected by:

  • Delayed market data;
  • Stale prices;
  • Incorrect prices or dates;
  • Missing or incomplete records;
  • Corporate-action adjustments;
  • Symbol or contract-mapping errors;
  • Calculation errors;
  • Charting errors;
  • Data-vendor errors;
  • Software defects;
  • Model or algorithm errors;
  • Artificial-intelligence errors;
  • Transcription or formatting errors;
  • Revised economic data;
  • Differences among exchanges, brokers, or data providers; and
  • Events occurring after publication.

Prices, dates, technical levels, expiration dates, contract specifications, economic releases, and other market information should be independently verified before being used for any purpose.

If we identify a material error, we may correct, update, replace, annotate, or remove the affected content. We are not obligated to issue a correction for every typographical, formatting, immaterial, or non-substantive error.

7. Use of Automated and Artificial-Intelligence Tools

Rosenblum Consulting may use software, algorithms, statistical systems, automated analytical tools, or artificial intelligence to assist with data processing, analysis, chart creation, drafting, editing, validation, or publication.

These tools may generate incorrect, incomplete, misleading, inconsistent, or outdated information. Human review may reduce but does not eliminate these risks.

The use of automated tools does not transform the Service into an automated trading service, personalized advisory service, managed-account service, or guarantee of analytical accuracy.

8. Positions, Trading, and Conflicts of Interest

Rosenblum Consulting, its owners, authors, employees, contractors, contributors, or related persons may hold long, short, option, futures, or other positions in financial instruments discussed through the Service. Those positions may be opened, increased, reduced, hedged, or closed without notice.

The interests and trading activities of such persons may differ from the views or scenarios described in a publication. Nothing in the Service represents a promise that an author or related person will personally trade in accordance with a published view or continue holding a position after publication.

When applicable law requires disclosure of material compensation, sponsorship, or a relationship connected to a financial instrument discussed, the relevant disclosure will be included in or presented with the applicable content.

A general conflict disclosure on this page does not replace any more specific position, compensation, sponsorship, or relationship disclosure included with a particular publication.

The Service may reference, quote, summarize, embed, or link to third-party websites, publications, data providers, social-media accounts, research, services, or other resources.

Third-party content is provided for convenience or context. Rosenblum Consulting does not control and is not responsible for the accuracy, availability, security, legality, policies, products, services, or content of third parties.

A link, reference, quotation, or mention does not necessarily constitute an endorsement, sponsorship, affiliation, partnership, or recommendation.

Your use of third-party websites and services is governed by the terms and policies of those third parties.

10. Eligibility and Account Registration

You must be at least 18 years old and legally capable of entering into a binding agreement to create a paid account or subscribe to the Service.

You agree to provide accurate and current account and billing information. You are responsible for maintaining the confidentiality and security of your login credentials and for activity conducted through your account.

You may not:

  • Share a paid account or login credentials with another person;
  • Allow multiple individuals to use an individual subscription;
  • Impersonate another person;
  • Create an account using false information;
  • Attempt to gain unauthorized access to another account;
  • Circumvent access controls or a paywall; or
  • Use the Service for an unlawful, fraudulent, or abusive purpose.

Notify us promptly at newsletter@rosenblum-consulting.com if you believe your account has been accessed without authorization.

11. Monthly Subscription and Automatic Renewal

Paid subscriptions are offered on a monthly recurring basis unless otherwise clearly stated at checkout.

Before purchase, the applicable subscription price and material billing terms will be displayed through the checkout process. By purchasing a monthly subscription, you authorize Rosenblum Consulting and its payment processor to charge the payment method you provide:

  1. At the time of purchase; and
  2. Automatically each month thereafter at the then-applicable subscription price, plus any required taxes, until you cancel.

Your subscription renews automatically each month unless canceled before the next renewal charge.

Promotional, introductory, discounted, or trial pricing, if offered, may expire at the end of the disclosed promotional period. After that period, the subscription may renew at the regular price disclosed when you enrolled or as otherwise disclosed to you.

We may change subscription pricing prospectively. Any price change will apply only after notice required by applicable law and will not retroactively change fees already paid.

12. Cancellation

You may cancel your subscription at any time through the subscription-management or account portal available on the website. You may also request cancellation assistance by contacting newsletter@rosenblum-consulting.com.

Cancellation prevents future recurring charges. Unless otherwise stated or required by law, cancellation does not retroactively reverse a charge already incurred, and your paid access will continue through the end of the billing period for which payment was received.

To avoid the next monthly charge, cancellation must be completed before the next renewal is processed.

Changing email-delivery preferences, clicking an email-unsubscribe link, ceasing to read the publication, deleting an email, unfollowing a social-media account, or failing to use the Service does not by itself cancel a paid subscription or stop recurring charges. Paid subscriptions must be canceled through the account-management process or with cancellation assistance from the support contact above.

We will not intentionally impose unreasonable barriers to cancellation.

13. Refunds

Except where required by applicable law or expressly stated in a written offer, subscription fees are nonrefundable after they have been charged.

We do not ordinarily provide:

  • Prorated refunds for a partially used billing period;
  • Refunds based on failure to use or read the Service;
  • Refunds based on dissatisfaction with market outcomes;
  • Refunds because published analysis proved incorrect;
  • Refunds because content did not address a particular security or topic;
  • Refunds after a subscriber failed to cancel before renewal; or
  • Refunds for an account terminated because of a material violation of these Terms.

Nothing in this section limits rights or remedies that cannot legally be waived.

14. Payment Processing and Taxes

Payments may be processed by Ghost, Stripe, or another third-party payment processor. Rosenblum Consulting does not necessarily receive or store complete payment-card information.

Your use of a third-party payment service may also be governed by that provider’s terms and privacy policies.

You are responsible for applicable taxes, duties, or governmental charges associated with your purchase, except for taxes imposed directly on Rosenblum Consulting’s income.

If a payment is declined, reversed, disputed, refunded, or otherwise not successfully completed, we may suspend or terminate paid access.

15. Access to the Service

An active paid subscription provides access to the paid content and features designated for the applicable subscription tier.

We may modify the Service’s design, format, publication frequency, delivery method, features, subject coverage, archives, or included content. We do not guarantee that any particular author, feature, chart, market, security, indicator, or category will continue to be covered.

Temporary interruptions may occur because of maintenance, technical failures, vendor outages, cybersecurity events, internet failures, payment-processing issues, data interruptions, or other circumstances.

We do not guarantee uninterrupted, continuous, timely, or error-free access.

16. Intellectual Property

Unless otherwise identified, the Service and its original content—including text, newsletters, charts, graphics, branding, designs, compilations, analytical frameworks, reports, commentary, and other materials—are owned by Rosenblum Consulting or used with permission.

Subject to these Terms and an active subscription where required, you receive a limited, revocable, nonexclusive, nontransferable license to access and use the Service for your personal, noncommercial use.

Without prior written permission, you may not:

  • Copy or reproduce substantial portions of the Service;
  • Redistribute newsletters or paid content;
  • Forward paid publications to non-subscribers;
  • Publish screenshots or copies of paid content;
  • Resell, sublicense, or commercially exploit content;
  • Share account credentials;
  • Circumvent access restrictions;
  • Scrape, crawl, harvest, or systematically extract content or data;
  • Create a competing publication, dataset, or commercial product from the Service;
  • Remove copyright, trademark, attribution, or proprietary notices;
  • Use automated systems to reproduce or archive the Service; or
  • Use substantial portions of the Service to train or improve a commercial artificial-intelligence system without written authorization.

Limited quotation for commentary, criticism, news reporting, or other uses permitted by applicable law is not prohibited by this section.

“The Rosenblum Technical,” associated logos, and related branding may not be used in a manner likely to suggest sponsorship, endorsement, or affiliation without written permission.

17. Comments and Community Features

If the Service permits comments, replies, or community participation, you remain responsible for material you submit.

You may not submit content that is unlawful, threatening, harassing, defamatory, fraudulent, infringing, deceptive, promotional spam, malicious, or designed to manipulate financial markets.

Do not use comments or community features to:

  • Solicit securities transactions;
  • Promote undisclosed paid securities content;
  • Share material nonpublic information;
  • Request personalized financial advice;
  • Coordinate market manipulation;
  • Collect financial-account credentials; or
  • Impersonate Rosenblum Consulting or another person.

We may moderate, restrict, remove, or preserve submitted material in our discretion, subject to applicable law.

18. Electronic Communications

By creating an account or subscribing, you consent to receive electronic communications reasonably related to your account, billing, subscription, security, changes to the Service, and these Terms.

You may manage newsletter and promotional-email preferences through the options provided in the applicable communication or account settings. As explained above, changing email preferences does not necessarily cancel a paid subscription.

19. Privacy

Our collection and use of personal information are governed by our Privacy Policy.

By using the Service, you acknowledge that internet transmissions and electronic storage cannot be guaranteed to be completely secure.

20. Prohibited Reliance and Subscriber Responsibility

You agree that you will not treat the Service as a substitute for your own research, judgment, due diligence, or professional advice.

You are responsible for independently evaluating:

  • The accuracy and timeliness of information;
  • Whether a financial instrument is appropriate for you;
  • The risks of any transaction;
  • Position size;
  • Liquidity;
  • Taxes;
  • Transaction costs;
  • Broker requirements;
  • Margin requirements;
  • Regulatory restrictions; and
  • The suitability of any decision under your personal circumstances.

Any decision made after reading or viewing the Service remains your decision and responsibility.

21. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

ROSENBLUM CONSULTING DISCLAIMS, TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALL WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, TIMELINESS, AVAILABILITY, SECURITY, AND ERROR-FREE OPERATION.

WE DO NOT WARRANT THAT:

  • The Service will satisfy your expectations;
  • The Service will be uninterrupted or secure;
  • Information will be accurate or current;
  • Errors will be identified or corrected;
  • Any particular market analysis will be successful; or
  • Use of the Service will produce any financial benefit.

Some jurisdictions do not permit certain warranty exclusions. In those jurisdictions, the exclusions apply only to the extent legally permitted.

22. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ROSENBLUM CONSULTING AND ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, CONTRIBUTORS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY:

  • Investment or trading loss;
  • Loss of principal;
  • Lost profits;
  • Lost opportunity;
  • Missed transaction;
  • Difference in execution price;
  • Tax consequence;
  • Business interruption;
  • Loss of data;
  • Loss arising from delayed or inaccurate information;
  • Indirect, incidental, special, consequential, exemplary, or punitive damages; or
  • Damage arising from reliance on or inability to access the Service.

This limitation applies regardless of whether the alleged liability arises from contract, tort, negligence, strict liability, statute, or another theory and regardless of whether Rosenblum Consulting was advised that such harm was possible.

To the maximum extent permitted by law, Rosenblum Consulting’s total aggregate liability arising from or relating to the Service will not exceed the greater of:

  1. The subscription fees you paid to Rosenblum Consulting during the six months immediately preceding the event giving rise to the claim; or
  2. One hundred U.S. dollars.

Nothing in these Terms excludes or limits liability that applicable law does not permit to be excluded or limited.

23. Indemnification

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Rosenblum Consulting and its owners, officers, directors, employees, contractors, contributors, affiliates, licensors, and service providers from claims, liabilities, damages, judgments, losses, costs, and reasonable legal fees arising from:

  • Your unlawful or unauthorized use of the Service;
  • Your violation of these Terms;
  • Your infringement of another person’s rights;
  • Content you submit through the Service; or
  • Your misuse, reproduction, or redistribution of Service content.

24. Suspension and Termination

We may suspend, restrict, or terminate your access if we reasonably believe that you:

  • Violated these Terms;
  • Shared paid access or content without authorization;
  • Attempted to compromise the Service;
  • Used the Service unlawfully;
  • Engaged in abusive, fraudulent, or disruptive conduct;
  • Failed to complete payment; or
  • Created legal, regulatory, security, or operational risk.

Termination does not eliminate obligations or liabilities that arose before termination.

Sections that by their nature should survive termination—including intellectual-property protections, disclaimers, limitations of liability, indemnification, governing law, and dispute provisions—will survive.

25. Changes to the Service and Terms

We may revise these Terms from time to time.

The updated version will be posted with a revised “Last Updated” date. Material changes may also be communicated by email, account notification, or another reasonable method where required by law.

Changes will apply prospectively from their stated effective date. Continued use of the Service after revised Terms become effective constitutes acceptance of those Terms to the extent permitted by law.

If you do not agree to revised Terms, you must stop using the Service and cancel your subscription before the next renewal.

26. Governing Law and Venue

These Terms and any dispute arising from or relating to the Service will be governed by the laws of the State of Alabama, without regard to conflict-of-law principles.

Subject to any rights that cannot legally be waived, you agree that any judicial proceeding arising from or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Madison, AL, and you consent to the personal jurisdiction of those courts.

27. Severability

If any provision of these Terms is found invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted or modified as necessary to make it enforceable. The remaining provisions will continue in effect.

28. No Waiver

A failure or delay by Rosenblum Consulting in enforcing a provision of these Terms does not waive the right to enforce that or another provision later.

29. Assignment

You may not assign or transfer your rights or obligations under these Terms without prior written consent.

Rosenblum Consulting may assign or transfer these Terms in connection with a merger, acquisition, reorganization, sale of assets, change of control, or transfer of the Service, subject to applicable law.

30. Entire Agreement

These Terms, the Privacy Policy, and any material subscription terms disclosed at checkout constitute the entire agreement between you and Rosenblum Consulting concerning the Service.

If a specific written offer or checkout disclosure conflicts with these Terms regarding subscription price, promotional duration, or billing frequency, the more specific disclosure will control for that transaction.
